Terms and conditions of use of the website www.libreriageografica.com of Geo4Map S.r.l.

The website www.libreriageografica.com (hereinafter the “Site”) owned by Geo4Map S.r.l. is an online information service provided by Geo4Map S.r.l. (hereinafter “Geo4Map”). Its use is subject to acceptance of the terms and conditions set out below. If you do not intend to accept these conditions, you are invited not to use the Site.

Object and purpose of the Site

The Site pursues the sole purpose of advertising Geo4Map's editorial products (hereinafter the "Products") to those who access and/or browse the Site (hereinafter the "Users"). Therefore, access to the Site and navigation on it can never, under any circumstances, lead to the conclusion of a sales contract and/or the conclusion of other contractual relationships between Users and Geo4Map. The Site contains links, banners and/or other hyperlinks to sites of parties other than Geo4Map through which it is possible to purchase the products advertised online also on the Site. Geo4Map is not part of the sales contract and/or any other contract possibly concluded between the aforementioned subjects and the Users. Geo4Map is therefore in no way responsible, either directly or by way of guarantee, for any such legal transactions and/or the sale of the Products online and/or the provision of services by parties other than Geo4Map itself, and this regardless of the the fact that links, banners or other hypertext links to the sites of the aforementioned various subjects are present on the Site. The contractual conditions prepared by the latter and accepted by the Users apply to any contracts concluded between the Users and the owners of the sites to which the links, banners or other hyperlinks on the Site refer. Before carrying out commercial transactions with these entities, it is therefore necessary for Users to verify their conditions of sale. On the websites accessible via the aforementioned links, banners and/or hyperlinks, Geo4Map does not carry out any checks and\or monitoring. Geo4Map is therefore not responsible for the contents of such sites nor for any errors and\or omissions and\or violations of the law on their part. Geo4Map also does not guarantee that the Products advertised on the Site are then available for purchase elsewhere regardless of whether the web page where the Product is advertised contains links, banners or other hyperlinks to different sites, including e-commerce ones.

Author's rights and Copyright

All contents of the Site, such as, by way of example, works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material, in any format (including menus, web pages, graphics, colors, schemes, tools, fonts and Website design, diagrams, layouts, methods, processes, functions and software) (hereinafter the “Contents”) are protected by copyright and any other intellectual property rights of Geo4Map. Geo4Map is therefore the sole owner of the intellectual property rights and/or use and economic exploitation of the Site and all its Contents.
Users acknowledge that, when accessing and browsing the Site, they can view the Contents and become aware of confidential information, know-how and work methodologies which are protected by intellectual property laws in favor of Geo4Map . Users therefore undertake to respect Geo4Map's rights deriving from said intellectual property.
The reproduction, modification, duplication, copying, distribution, sale or in any case exploitation of the Site Contents as well as any use of the Site Contents for commercial and/or advertising purposes is also prohibited.
Under no circumstances may Users alter, change, modify or adapt the Site and/or its Contents.

Limits of liability

The information contained in the Site is provided in good faith by Geo4Map and is periodically updated and verified. Geo4Map will ensure that the information contained on the Site meets, to the greatest extent possible, the requirements of reliability, correctness, accuracy and timeliness. Geo4Map, moreover, is relieved of any responsibility for any errors or inaccuracies in the content of such information, assumes no obligation to update the same and has the right to make any changes to the materials present on the Site, to the products described therein and to the their prices, at any time and without any obligation to communicate.
Under no circumstances will Geo4Map be held responsible for any direct or indirect damage arising from the use of the information contained in this Site or from the Contents of the Site itself. Consequently, the person who made decisions based on the information contained in this Site is also fully responsible for them.
The information provided on the Site may refer to products, programs or services that are not available in your country. It is necessary to consult the Geo4Map to obtain information relating to the products, programs or services that are available for the specific User. This exclusion of warranty applies to the maximum limits permitted by current legislation.

E-commerce service

The Geo4Map e-commerce service is entirely managed by Geo4Map S.r.l. – Via Leonardo da Vinci 18 – Novara. Consequently, all the rules, conditions of purchase and return provided by Geo4Map S.r.l. are valid.

Definition of Purchase

The website (www.libreriageografica.com) of the publishing house Geo4Map S.r.l. with headquarters in Via Leonardo da Vinci 18, 28100 Novara, tel. 0321 1696587 – e-mail: cliente@libreriageografica.it, contains the catalog of volumes published and/or marketed by Geo4Map (hereinafter collectively, also with reference to volumes which consist of or have attached audiovisual material or computer software, the "Volumes"). By registering on the Site, the User expresses his/her consent to these General Conditions of Sale (hereinafter the "General Conditions") and to all the provisions that regulate the use of the Site including, by way of example, the Terms and the General Conditions of Use of the Site and the Site's Privacy Policy, published on another page of the Site, which regulate registration, access, navigation and general use of the Site.
The Site and the material contained therein do not constitute an offer to the public, but are exclusively a mere invitation to offer. Each product order sent to Geo4Map by a customer (hereinafter the "Customer") constitutes a contractual proposal from the Customer and, therefore, will be binding for Geo4Map only if, and when, confirmed by the same for acceptance. Geo4Map will send the acceptance by e-mail after having verified the completeness and correctness of the order as well as the availability of the products ordered. This acceptance email (hereinafter also "Shipping Confirmation") is therefore sent by Geo4Map to the Customer at the time of shipment of the products.
The contract will be considered concluded when the Shipping Confirmation has reached the email server used by the Customer. The General Conditions are regulated by Legislative Decree 6 September 2005, n. 206 (hereinafter, the “Consumer Code”), as last amended by Legislative Decree 21 February 2014, n. 21, implementing Directive 2011/83/EC and Legislative Decree 9 April 2003, n. 70, implementing Directive 2000/31/EC relating to certain legal aspects of information society services, with particular reference to electronic commerce. The General Conditions are only available in Italian.
The concluded contract will be archived through an electronic system and will be accessible to Geo4Map personnel who need to know it in relation to the execution of the contract, to any third parties that Geo4Map uses for the execution of the contract and to the legitimate recipients pursuant to the current legislation. By sending the order form to Geo4Map, the Customer consents to Geo4Map's use of the telephone, e-mail and other automated calling systems without the intervention of an operator in relation to the conclusion and execution of the contract.

Payment methods

Customers will be able to make online payments via credit card or Paypal account. In any case, the contract will be considered concluded upon receipt of the Shipping Confirmation by the customer. Both for payment by credit card and for payment with a Paypal account at the conclusion of the online transaction, the relevant banking institution will authorize the commitment only of the amount relating to the purchase made. In the event of cancellation of the order, either by the Customer or in the case of non-acceptance of the same by Geo4Map, Geo4Map will simultaneously request the cancellation of the transaction and the release of the committed amount. The release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiry (typically up to 30 days from the authorization date). Once the transaction has been canceled, in no case can Geo4Map be held responsible for any damages, direct or indirect, caused by delay in the failure to release the committed amount by the banking system. Geo4Map reserves the right not to accept incomplete or incompletely completed orders. In the event of failure to execute the order by Geo4Map due to unavailability of the Volumes ordered by the Customer, Geo4Map will proceed as soon as possible, within the terms and in the manner established by the art. 56 of the Consumer Code, to inform the Customer, refunding, without undue delay, any sums already paid by them for the supply not carried out. The prices of the Volumes specified on the Site include taxes; delivery costs are excluded. In case of payment by credit card, Geo4Map will charge the amount relating to the order only when sending its acceptance of the order itself. The tax documentation relating to the Volumes ordered will be issued by Geo4Map upon completion of the payment.
If a "private" customer (without VAT number) wishes to receive an invoice in his own name, he must, after placing the order, write an e-mail to clients@libreriageografica.it with the subject: "Request invoice for order xxx" (report order number Otherwise, Geo4Map will not issue an invoice.

Delivery

The notes regarding the delivery costs of the volumes are linked to the terms of the agreement. Deliveries can be made, possibly even beyond the 30 day limit referred to in the art. 61, paragraph 1 of the Consumer Code, via standard courier or express courier; the Customer will determine the chosen shipping method when completing the Form. All deliveries are made at street level. The delivery terms indicated refer to the Volumes present in Geo4Map's logistics warehouses, and although carefully evaluated, must be considered non-binding for Geo4Map, in consideration of the possibility that the Volumes may be out of stock at the time of collection from the warehouse by Geo4Map. In this case, Geo4Map will immediately inform the Customer of the new delivery times which, in derogation of the art. 61, paragraph 1 of the Consumer Code, may however, in any case, exceed 30 days. Any delays in deliveries of less than 60 (sixty) days do not give the Customer the right to refuse delivery of the Volumes, nor to claim compensation or compensation of any kind. In case of delays in deliveries exceeding 60 (sixty) days, the Customer may invite Geo4Map to make the delivery within the deadline specified by it and, if this deadline is not respected by Geo4Map, he will have the right to cancel the order and receive the refund of any sums already paid, without prejudice to compensation for damages. Upon the Customer's choice of the "Partial Delivery" option, Geo4Map has the right to deliver the Volumes (even relating to the same order) in multiple successive deliveries. Geo4Map, through its logistics, also reserves the right to proceed with "Partial Delivery" in the event that one or more products included in the order, as indicated in the Shipping Confirmation, prove to be unavailable: in this case only the products will be sent available. Consequently, the amount of the unavailable product in the order will be credited back, as specified in the Shipping Confirmation, and in case of payment made by credit card, a partial charge will be made. The Shipping Confirmation will contain the confirmation documentation required by the art. 49 of the Consumer Code. In any case, the Customer will be able to obtain the aforementioned information by consulting the Site and downloading this document containing this information onto its own media for printing or archiving. Finally, the Volumes will be accompanied by a document containing written confirmation of the information referred to in the art. 49 of the Consumer Code.

Right of Withdrawal

Pursuant to art. 64 of the Consumer Code, the Customer (if he qualifies as a "consumer" pursuant to art. 3 of the Consumer Code) has the right to withdraw from the contract and return the Volumes ordered and/or any audiovisual material and attached computer software, provided that they are in the same condition in which you received them, or, in the case of audiovisual material or computer software, still in the original sealed packaging. This refund can be made without any penalty and without specifying the reason. The right of withdrawal must be exercised by the Customer by sending an email to cliente@libreriageografca.it within 14 (fourteen) working days of receipt of the Products.
All returns must be authorized by Libreria Geografica Customer Service who will respond with an email authorizing the return if the conditions set out above have been respected. Once this authorization has been received, the Customer can send the Volume back to the following address: Geo4Map S.r.l., Via Leonardo da Vinci 18, 28100 Novara. The return of the volume or volumes must take place within 10 (ten) days of receipt of the email authorizing the return. Shipping costs will be entirely borne by the Customer, and cash on delivery parcels will not be accepted. Once the Volumes have been received and their integrity has been verified, if they are not damaged, Geo4Map will proceed, as quickly as possible and in any case in compliance with the terms and methods provided for in this regard by the art. 5 paragraph 7 of the Decree governing the Right of Withdrawal, to credit the Customer with the cost of the returned Volumes, withholding, where necessary, the amount of any shipping costs not paid by the Customer, which will remain definitively the responsibility of the Customer. The right of withdrawal cannot be exercised by the Customer if the purchased Volumes contain sealed attachments (such as audio cassettes, CD-ROMs, etc.), which have been opened by the Customer himself or if the Volumes are damaged. Any attachments to the Volume (such as audio cassettes, CD-ROMs, etc.) must be returned together and still sealed. Furthermore, the right of withdrawal cannot be exercised by the Customer for the purchase of newspapers or magazines.

User Communications

With the exception of personal data, the processing of which is subject to the provisions of Legislative Decree 30 June 2003, n. 196 and is regulated as described in the Site's Privacy Policy, any material, information or other communication that is transmitted or stored on the Site will be considered non-confidential and not subject to any proprietary rights ("Communications"). Geo4Map does not assume any commitment in relation to the Communications, and will be free, together with its representatives, to copy, communicate, distribute, incorporate, delete and in general to use the Communications and all data, images, sounds, texts, and any other content thereof for any purpose, whether for profit or not. The transmission or storage on or from the Site of any material that is unlawful, threatening, defamatory, obscene, pornographic or otherwise in violation of any law is prohibited.

Users

No person under the age of 18 may use the Site without parental or guardian consent. All parents and guardians are strongly encouraged to monitor the use of the Internet by their children/minors under their responsibility. Use of the Site by any User will be understood as a declaration that the User is at least 18 years old.

User Obligations

The User undertakes not to engage in any of the following conduct while using the Site:
– Falsify your personal identity;
– Transmit any material or promote "links" with obscene, vulgar, fraudulent, defamatory, libelous, threatening, confidential, illegal or otherwise objectionable content;
– Harass, undermine, threaten, embarrass or cause difficulty or inconvenience to other participants, Users, or other natural or legal persons;
– Attempt to transmit anything that is technically dangerous, including, but not limited to, viruses, “Trojan horses”, logic bombs, “worms”, dangerous components or other tools that may cause destruction or failure of the computer support and system;
– Promote chain letters or pyramid schemes of correspondence or advertising material, send or transmit any type of unsolicited promotional material or any other form of unsolicited solicitation;
– Violate the right to protection of personal data and any other personal and exclusive rights of any natural or legal person;
– Carry out behavior that in any way violates current legislation.
The User is responsible for the content of any contribution or message sent on the Site. The User may only send personal data strictly functional to the purpose of the communication sent, provided that such purpose is permitted pursuant to the Conditions and Notes and as reported on the Site in the relevant section; the User must not send sensitive data of his own or of third parties. Any sensitive data received through the Site will be immediately permanently deleted by Geo4Map and will not be processed in any way. The User cannot send confidential information relating to third parties to the Site.

Registration on the Site

Registration on the Site occurs by creating a personal account and, after viewing and accepting this Communication and the Information relating to the processing of personal data, by clicking on the appropriate box at the bottom ("read and accepted" box) on the home page of the Site. The refusal to take note of the contents of this Communication and in the Information relating to the processing of personal data will make it impossible to register on the Site.
Registration on the Site is free. To register, the User must complete the registration form, entering their name, surname, an e-mail address and a password (hereinafter the "Registration Credentials").
The Registration Credentials must be used exclusively by the User and cannot be transferred to third parties. The Registration Credentials may be modified by the User at any time by accessing the "My Account" section on the Site.
The User guarantees that the Registration Credentials provided during the registration procedure on the Site are complete, correct and truthful.
The User is solely responsible for accessing the Site using the Registration Credentials and is directly responsible for any damage or prejudice caused to Geo4Map or third parties by improper use, loss, misappropriation by others or failure to protect of adequate secrecy of their Registration Credentials. Users agree to hold Geo4Map harmless from any compensation obligation, sanction deriving from and\or in any way connected to the violation by Users of the rules on registration on the Site.
It is possible to make a single registration for each User. Multiple registrations will be deleted from Geo4Map.
Geo4Map reserves the right to refuse, at its sole discretion, the registration of Users.
Users may cancel their subscription at any time by sending an email to cliente@libreriageografica.it.

Links

Geo4Map is not responsible for the content of any other site that can be reached from the site www.libreriageografica.com or through which this Site can be accessed. Anyone who decides to visit a site linked to the site www.libreriageografica.com does so on their own risk, assuming the burden of taking all necessary measures against viruses or other destructive elements. Geo4Map makes it known that it has no control over the content of such sites and as a mere third party has no responsibility for the content and material, including advertising, disclosed on such sites or for the products or services offered. These products or services cannot be considered in any way sponsored, shared or supported by Geo4Map.

Messages and information sent via the Site

The User assumes all responsibility for the content of the messages sent, recognizing that he/she is solely responsible for them and declaring and guaranteeing that he/she has legitimately acquired the contents, relieving Geo4Map - as well as the companies and/or subjects connected to it or controlled by it, its representatives, employees as well as any partner of Geo4Map - from any consequent request for damage or compensation, indemnifying Geo4Map from any possible burden deriving from claims or actions of third parties against Geo4Map, the companies and subjects mentioned above for damages arising in any case from the behavior of the User or of people authorized by the User to access the Geo4Map Site.
Any information and material provided by any User through the Website will not be considered confidential or proprietary in nature. Therefore Geo4Map reserves the right to freely use such information and material in the manner it deems appropriate. Anyone who sends material and/or information guarantees that it is publishable and agrees to hold Geo4Map harmless and harmless from any action by third parties in relation to such materials and information.

Use for lawful purposes

The User undertakes to use the website www.libreriageografica.com and its services exclusively for lawful purposes and, in any case, without infringing the rights of any third party and paying particular attention to data protection regulations, laws regarding protection of intellectual and industrial property, the protection of personal data, the current regulations on cyber crime and the legislation on telecommunications.

Insertion of links to the site www.libreriageografica.com on third party sites

Anyone wishing to create a LINK to the Geo4Map Site must comply with the applicable legislation in force. The link to the Geo4Map Site is also permitted only in compliance with the following guidelines:
